The following General Terms and Conditions exclusively apply to orders placed with the online shop of Deichmann-Shoes UK Ltd (Deichmann). By placing an order with Deichmann you are deemed to have understood and accepted these terms. If required, you can download and print the text.

Contract Terms

Our product descriptions and prices stated during the order process are subject to confirmation and non-binding.

You submit a binding offer to Deichmann when you have passed the order process, stating all details required and have clicked on the button "send order" in step 4. Having sent your order, we shall send you an email confirming the receipt of your order and listing all relevant details (Order confirmation). This order confirmation does not represent an acceptance of your order; it just serves the purpose of informing you that we have received your order. We reserve the right to refuse to accept and order in whole or in part. All orders are treated as placed and received in the United Kingdom and all contracts for the sale of goods are subject to the law in England and subject to the exclusive jurisdiction of the English courts. A contract of sale is only concluded when we accept your order by supplying the goods. You can track the status of your order in "My account" under "Your orders". The minimum age for placing an order at the online shop is 18.

Storage of your order details

Your order details are stored on the Deichmann website. If you require a hard copy, you can print the "Order confirmation". This will appear on your screen once you submitted your order. If you have provided us with your email address, you will in addition receive all relevant data of your order by email, which you can also print out.

Payments

Payments can be made by credit/ debit card (Visa, MasterCard,), or PayPal. All prices are stated in GB Pounds, including the statutory VAT of currently 20%. The prices valid at the time of placing the order shall apply. All products supplied remain the property of Deichmann until they have been paid in full.

Warranty / Guarantee

In the event that the goods received are damaged or defective Deichmann will at our own option replace, repair or refund the amount originally paid for them. This can be done at any of our Deichmann stores (simply use our Location Finder) or by returning the goods via the Royal Mail or Collect Plus.

Cancellation policy

Deichmann offers customers the facility to exchange goods or obtain a refund, which is in addition to your legal rights. The only conditions are that the goods are in a new and unworn condition, in their original packaging, that the customer provides a proof of purchase and they are returned to us either in store or to the returns address within 28 days of receipt.

Cancellation Rights

Under Distance Selling Regulations, you may cancel your contract with us within 8 days without having to specify any reasons. This can be done either in writing (e.g. email (to e-commerce-duk@deichmann.com) or letter) or by returning the goods. The period begins on the later of the date of receipt of these cancellation rights or the date the customer received the goods (in case of recurring deliveries of the same type of goods the date of receiving the first partial delivery). Goods can either be returned at any of our Deichmann stores (simply use our Location Finder) or via Royal Mail or Collect Plus.

Consequences of cancellation

In the event of an effective cancellation, any contributions received by either party must be returned and, where applicable, any benefits received (e.g. interest) are to be surrendered. If you are not able to return all or part of the goods or only in deteriorated condition, you are obliged to reimburse us with the respective value. This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods as it would have been possible in a shop. However, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect their value. Obligations to refund payments must be met within 30 days of the customer notifying us of their wish to cancel.

Complaints/mediation

The European Commission provides an EU-wide online dispute resolution service. This enables consumers to resolve disputes about online transactions without having to go to a court. Severability Clause

Should any of the provisions of these General Terms and Conditions be or become ineffective, the statutory provisions will apply instead of the ineffective provision. This will not affect the validity and enforceability of the remaining provisions

Deichmann Shoes UK Ltd collects personal data about you through its stores, website, app, (win) promotions and other services. Your privacy is our top priority, so we will gladly tell you what data it is, what we do with it and how we keep it private.

Purposes of use

Below is an overview of the personal data that we process for each purpose - how much we know about you is partly dependent on the data you enter by yourself, for example, creating an account or participating in a contest.

Order, pay , return

When you buy a product via deichmann.com we need personal data to process the order, payment and possibly the return shipment. For this purpose we store this information: salutation, first and last name, (invoice) address details, e-mail address, telephone number, order and payment details, IP address, device.

Delivery

In order to deliver your package at the desired location, we will pass this information on to our delivery partner: salutation, first and last name, address details, e-mail address and telephone number.

We use cookies and other techniques on our website . As a result, we ensure that you do not have to re-enter your details on a new visit. We remember what you have placed in your shopping cart or we can show what you have looked at before. The website therefore works faster and becomes more personal. We also use cookies for marketing purposes. We place advertisements that are aimed at you and leave non-relevant e advertisements away (eg you do not always see the shoes you just bought in banners on another website).

Data concerned: technical details of the equipment you use (smartphone / computer / tablet / kiosk in the store), such as IP address, MAC address and software used and your surfing behaviour on our website, including mouse and click behaviour and duration and time of your visit on our website.

In order to make the visit to our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These serve to make our website more user-friendly, effective and secure overall and to accelerate navigation on our platform. These are small text files that are stored on your device. Artefact

On our websites we use an artefact tracking tool,  a cookie product of Artefact Germany GmbH, Philosophenweg 21, 47051 Duisburg, Germany (called ""Artefact"" in following). With this tool user data is collected and processed for marketing and optimization purposes. These data are used to create pseudonymized user profiles. The web server of Artefact stores the following information about each visitor of our websites: name of your internet service provider (ISP), the website from which he visits us, other websites he visits along with the date and time spent on each of them. The collected data does not contain your name, address or your e-mail address and therefore does not allow any kind of personal identification.

You can prevent the use of Artefact Tracking via the cookie settings of your browser. Be advised, however, that in this case not all features of this website may be fully usable.

As an alternative to the browser settings, especially if you visit our website via browsers on mobile devices, you can prevent the collection of data by Artefact by clicking on the link https://artefact.com/de/opting-out-of-cookies/. Dynamic Yield 

This website uses the services of Dynamic Yield, a recommendation tool by Dynamic Yield GmbH (Alexanderufer 3, 10117 Berlin). Our online service is optimised by the recommendation tool Dynamic Yield to make your visit to our website a personalised experience through tailored recommendations and content. In doing this, we use the content of your previously visited sites to recommend you comparable or thematically-related products or other content you might find relevant. 

Dynamic Yield collects pseudonymised information about your user activity on our website. In the process, cookies are used, through which only pseudonymised information is saved under a randomly generated ID (pseudonym). Your IP addresses are only saved anonymously. You are not personally identifiable, nor can you be at a later date. You can disable data collection by Dynamic Yield by clicking on the following link. Deichmann app

Deichmann shoes UK Ltd has its own app with which you can order your favourite shoes anytime and anywhere and keep track of your wish list. When you download the app, we register your IP address and information about how to use the app. If you log in to your Deichmann account, we can show you (again by means of cookies) the most relevant and personal products, offers and settings. 

E-mails and newsletters

When you place an order with us you will receive various e-mails such as the order and shipping confirmation and a review request.

You can also sign up for our newsletter (via a double opt- in) . We try to make these newsletters as relevant as possible for you. That is why we ask for your interests (if you have no interest in men's shoes, we will not send you our men's newsletters, for example) and your shoe size (if you have a larger ladies or gentlemen's size, we will send special newsletters when new collection arrives). You can enter or change these interests in 'my account' at Deichmann.com.

We also use your buying behaviour to personalise the content of the newsletters. We create relevant newsletters dependent upon your behaviour after receiving news to make new selections: personal newsletter tracking. For example, we sometimes send newsletters to a group that has opened a specific newsletter (open behaviour) or that have clicked on specific shoes (click behaviour). We do not view this data on an individual level.

In every newsletter you have the option to unsubscribe and deactivate the personal newsletter tracking.

Data concerned: salutation, first and last name, e-mail address, date of birth, shoe size, interests, order history, open and click behaviour.

(Win) actions

We regularly have (win) promotions . Often for shoes or Deichmann gift cards, but also sometimes for tickets for events, other prizes or money. To be able to participate, we ask for your name, gender, e-mail address and optional date of birth, shoe size, interests and Post code. We also use this data to analyse the action. In order to receive your prize, we need your telephone number and address details and sometimes your account number. With every (online) promotion you will find the applicable promotion conditions.

Social Media

Deichmann uses social media to keep you up to date on the latest trends and products, to give you a look behind the scenes and to share offers. You can follow us on Facebook, Instagram, YouTube. The conditions of the social media platform, not those of Deichmann, apply to the use of this social media .

When you ask us a question via social media, we will save that message and your account name so that we can respond to your message. We also use the advertising possibilities of social media platforms. We show your ads on the basis of the data that the social media platform collects with your permission, eg that you follow us, what you are interested in or in which place you live. These data are not managed by Deichmann but are managed by the relevant social media platform; in your account there you can also adjust the settings.

Reviews and customer satisfaction survey

We love shoes and satisfied customers. That is why we regularly examine what you think of our products and service, so that we can continue to improve them.

We do this by sending a request for a review of the product you have purchased by e-mail. For this we make a connection between your e-mail address and your order details, so that we can be sure that you are the person who placed the order.

We use Hotjar on our website . A feedback tool with which we measure the online shop experience. The results are anonymous. For example, we ask you for the ease of use of our site and of the ordering process or tips. We also optimize our website through measurements and analyses based on cookies. In our cookie policy you can read which cookies we use and how you can adjust your cookie settings.

In the shops we share tickets for our customer satisfaction survey that can be filled in online. The data we store for this are: first and last name, e-mail address, gender and which store you judge.

Contact with customer service

If you have questions about products, stocks, your orders, payments or when you have a complaint, for example, our customer service is ready for you. You can mail and call, but also reach them via Facebook and Instagram. We can ask you for your name, order number / history, e-mail address, telephone number and address details. Under your customer ID we store your question or complaint, so that we can help you as quickly and as well as possible if you contact us again.

You can always contact your question or complaint in one of our stores. They record your data digitally or on paper. In the latter case , they then follow express instructions not to let your personal data swing and store them under lock and key, with access only for authorized persons. They are well trained!

Cameras

Deichmann stores are equipped with cameras for the sake of your safety and that of our employees and products. These camera images are deleted after 4 weeks, unless there are good reasons to keep the images longer, for example for a police investigation.

The security of your personal data

Deichmann shoes UK Ltd takes care to guarantee your privacy rights at all times. We have taken appropriate technical and organisational measures to protect your personal data against loss or against any form of unlawful processing. Our security measures are continually reviewed in accordance with technological developments.

The legal grounds for processing your personal data

We process your data because we either need this to enter into or execute the agreement with you (a), or because we (or a third party) have a legitimate interest in it (b), or with your permission (c) or because we are legally obliged to do so (d).

(a) Your details are necessary for ordering, delivering and returning your purchases and contacting our customer service about one of these processes.

(b) In addition, we want to offer you the most optimal personal service and therefore we can use your data on the basis of 'legitimate interest'. Naturally , we guarantee your privacy. Our legitimate interests are described in this privacy statement. It is a visit from the Deichmann website, the 'my account' on the site, the use of the Deichmann app, newsletters and e-mails, (win) actions, social media, reviews and customer satisfaction surveys, contact with customer service and security and cameras.

(c) In some cases, you expressly authorise us to use your data. This applies, for example, to your registration for the newsletter.

(d) It may occur that there are legal obligations to use your personal data; a suspicion of fraud is an example.

Share personal data with external parties

In a number of cases we provide your data to external parties (where necessary). We will never sell your data to other parties. External service providers with whom we work may only use your data for the execution of the relevant services (eg Evri only for the delivery of your order and a bank or payment provider only for the completion of the payment ). You can not use or pass on your data independently.

Information we collect through cookies may be shared with the parties involved in these cookies. You can read more about this in our cookie policy .

When we are legally obligated by government agencies or other parties to give your details, we only share the necessary information.

Where your data is stored

We store your data in various databases that are highly secure. Both in terms of technology and people's access to the data . Almost all these databases are owned by our German parent company Deichmann Schuhe , where the data is often stored in the EU (mostly in Germany ) and is only passed on in exceptional cases to countries outside the European Union. For data sent outside the EU , we work exclusively with parties that offer sufficient protection according to European rules. This has been established for a number of countries , eg for American parties that fall under the ' Privacy Shield '. And there are official model contracts specially designed to guarantee your privacy.

How long we save your data

We do not store your data longer than is legally permitted and necessary for the purposes for which you provided your information. With regard to the sending of newsletters, we keep the data as long as the consent of the recipient has not been withdrawn.

Your rights

From the General Data Protection Regulation (AVG) you have the right to access your personal data, the right to rectification and supplement, the right to be forgotten, the right to data portability, the right to object, the right to limit the processing and the right to a human look at decisions. See the heading 'contact information' for submitting such a request.

You can unsubscribe from the newsletter in the same account, but you can also use the link at the bottom of each newsletter. This privacy statement can be adjusted in the interim. The latest version name and date will always be published.
 

Data Privacy and Protection

Deichmann treats all stored personal data of registered users with utmost confidentiality. We only store data which is essential for maintaining a continued business relationship. The protection of personal data, such as name, email address, bank details, password and phone numbers is of paramount importance to us. Customers must also keep data securely in particular they must choose a password for their account which is not known by anyone else and must not disclose this to anyone else. If you believe your password may be known to someone else you must change it immediately.

Processing and storing your data may be necessary, for example to provide you with specific information. We use this data to the extent required to process your orders and maintain our business relationship with you as best as possible. Overall, Deichmann is able to ensure you that without your approval no personal data will be collected beyond our website.

We do not sell your personal information to third parties. Any service providers acting on behalf of Deichmann are not deemed third parties. These organisations are obliged to adhere to our contractually agreed duties towards you; they are also committed to our data protection policy. Any data passed to our service partners, e.g. email addresses, will be 'hashed' so that anything personal can not be read.

If you wish, we– (or our Deichmann partners) will send you information about our wide range of products and services or we will draw your attention to offers, which might be of interest to you. Such information may include information regarding offers, new products as well as new services. Should you no longer be interested in receiving such information, our websites will provide you with the option of unsubscribing from the relevant newsletter. You only need to enter your email address in "Unsubscribe newsletter" and you will no longer receive any mailings from us.

Price Promise

If a customer finds an identical pair of shoes on sale at any UK high street or online retailer at a cheaper price, Deichmann will price match that style and give an additional £1 to the customer.

If after purchase, the customer finds an identical pair of shoes on sale in any other UK high street or online retailer within 14 days at a cheaper price, we will refund the difference and give an additional £1 to the customer upon reviewing the receipt and proof of the competitor’s price and product.

Comparison styles must be identical to our product, i.e. brand, model, colour, gender, size. The identical pair of shoes must be in stock at the competitor.

Price matches and refunds are processed by Deichmann colleagues in-store or by the Deichmann Customer Services team. The Customer Services team can be contacted by emailing service-uk@deichmann.com

Online resellers or marketplaces such as eBay, Vinted, Depop, Etsy, Amazon resellers or Offerup are excluded and do not qualify for this Price Promise.
